Job Responsibilities

  • Act according to the organization interest in any legal proceeding or statutory rights and obligations duties and analyze the likely outcome of cases using knowledge of legal precedents.
  • Represent Boardwalk before the Tribunal administratif du logement and other courts for the 12 BRQ sites (+/- 3000 units).
  • Draw up and reply to formal notices to the organization and negotiate settlements of civil disputes in agreement with the leader.
  • Evaluate the merits of tenant claims based on legislation and jurisprudence.
  • Manage any request filed with the Tribunal administratif du logement in a civil cause of action, with the help of the area coordinator, or assist the area coordinator (according to the Tribunal administratif du logement Act).
  • Evaluate findings and develop strategies and arguments for preparing and pleading cases.
  • Non-payment: file claims for non-payment when required and as per leaders' request.
  • Civil cases: gather facts, witnesses, prepare representation, pleadings, and legal argument before the Tribunal).
  • Relocation and recovery compensation: file necessary claims for tenants who skip and / or cause damages to apartments, track or have these tenants tracked, send enforceable decision to collection agencies, prepare requests (obtain relevant information from stakeholders) and gather evidence, plead cases or support area coordinator during hearings (according to the Tribunal administratif du logement Act).
  • Fixing of rent: RN form preparation, obtaining information from head office in preparing the calculation for fixing rents, allocating expenses according to RN's items, pleading in court fixation cases. Provide at the end of the year the provisory increase rates to area coordinators for the coming year based on preliminary figures (RN Form).
  • Manage notifications by bailiffs, notices of hearing, orders, enforceable judgments in a timely manner, coordinate evictions with the bailiff as per enforceable judgment.
  • Act as a resource person for area coordinators and customer service associates for any questions regarding legal issues in the buildings or between tenants.
  • Prepare notices for major works in collaboration with the Capital Admin team.
  • Prepare and draft legal documents: contracts, parking spaces, storage space, buildings' rules, pleadings, affidavits, legal briefs, commercial lease contracts and renewals, etc. as per the leader's request.
  • Act as a resource person for insurance claims: send formal letters for claims, manage claimed amounts, reimbursement agreements with the lessee's insurer in collaboration with head office.
  • Perform any other related tasks as per the leader's request.

Skills and experience

  • Bachelor of Laws and member in good standing of the Barreau du Québec
  • Background in administration or graduate level education in a related field (asset)
  • In-depth knowledge of the Tribunal administratif du logement Act, Consumer Protection Act & Quebec Civil Code (asset)
  • Minimum of three (3) years of experience in insurance and / or disaster management
  • Experience in legal disputes (asset)
  • Strong ability to negotiate
  • Excellent verbal and writing skills, in both English and French
  • Proficiency with Microsoft Office Suite
  • Must own a vehicle and be able to travel within Quebec
