Responsabilités: Mener les négociations juridiques et fournir un soutien juridique pour des appels d’offres et des projets de construction de toute taille et complexité, notamment pour les projets d’infrastructure, commerciaux, industriels et énergétiques. Négocier et communiquer directement avec les clients, les partenaires, les sous-traitants et les parties prenantes participant à l’obtention de contrats de construction. Rédiger, réviser et négocier un large éventail d’ententes, dont des contrats du CCDC, des contrats de conception-construction, des contrats d’ingénierie-approvisionnement-construction, ainsi que des contrats de sous-traitance et de consultation. Conseiller quotidiennement les équipes de projet et contribuer à la gestion de litiges complexes en matière de construction. Gérer et encadrer les conseillers juridiques et les consultants externes dans le cadre de litiges de nature et de complexité variées. Contribuer aux activités quotidiennes du service juridique interne dynamique, notamment en matière d’enjeux commerciaux et de questions juridiques opérationnelles. Connaissance, compétences et expérience: 5 à 7 ans d’expérience juridique au sein d’un cabinet d’avocats ou d’un service juridique interne Bilinguisme (français et anglais), tant à l’oral qu’à l’écrit Baccalauréat en droit Membre en règle du Barreau du Québec Bonne connaissance du Code civil du Québec Capacité à négocier des contrats de construction et à gérer des litiges en français et en anglais Expérience en négociation de contrats de construction et en gestion des appels d’offres, ainsi qu’en modèles de réalisation de projets traditionnels, collaboratifs et de type alliance Expérience en prestation de conseils juridiques quotidiens aux équipes de projet et en gestion des différends, notamment en matière d’hypothèques légales, de réponses aux appels d’offres des maîtres d’ouvrage, d’appels d’offres aux sous-traitants, de cautionnements et de respect des exigences contractuelles Capacité à trouver des solutions créatives à de nouveaux problèmes et à exceller dans un environnement entrepreneurial Intérêt marqué pour le travail collaboratif avec des professionnels issus de divers secteurs de l’industrie de la construction You as a Legal Counsel will: Lead legal negotiations and provide all legal support for bids for construction projects of varying size and complexity, including projects in the infrastructure, commercial, industrial, and energy spaces Negotiating and liaising with clients, partners, subcontractors, and all other stakeholders involved in pursuit of construction projects Draft, review, and negotiate a wide range of agreements, including CCDC contracts, Design Build contracts, EPC contracts, and subcontracts and consultant agreements Provide day-to-day project advice and assist with the progression of complex construction disputes Manage and direct external counsel and consultants on disputes of varying size and complexity Assist in the day-to-day activities of an active in-house legal department, including corporate/commercial and legal operations matters Is this the right role for you? 5-7 years of legal experience at a law firm or in-house legal department Bilingual in French and English, spoken and written is required You posses a Bachelor of Laws and are licensed to practice law in Québec Experience with the Civil Code of Québec Ability to negotiate construction contracts and manage disputes in French and English Experience negotiating construction contracts and managing pursuits, including experience with both traditional project delivery models and new, collaborative or alliance-based delivery models Experience with providing day-to-day project advice and managing disputes, including with respect to hypothecs, responding to tenders from owners, subcontract tendering, bonds, and questions relating to compliance with contractual requirements Ability to develop creative solutions to new problems and thrive in an entrepreneurial environment A desire and ability to collaborate with professionals with different skills and backgrounds throughout the construction industry EllisDon is proud to provide this unique career opportunity that provides continuous learning, opportunity for growth, and a competitive compensation package within an environment that is committed to inclusion and respects diversity.
