Contributes to the overall success of the Legal Department in Canada ensuring specific individual goals, plans, initiatives are executed / delivered in support of the team’s business strategies and objectives. Ensures all activities conducted are in compliance with governing regulations, internal policies and procedures.

Accountabilities

  • Champions a customer-focused culture to deepen client relationships and leverage broader Bank relationships, systems and knowledge.
  • Supports the Bank’s Global Banking and Markets division in its wholesale capital markets and lending activities, including all types of derivatives, corporate lending and various forms of trading, financing and financial service arrangements with corporations, funds, institutions, central banks, governments and quasi-governmental institutions in respect of the Bank’s global operations. The incumbent will have a detailed knowledge of the legal and regulatory environment for financial institutions in Canada and other key jurisdictions and advise on a wide range of financial regulation and reform initiatives affecting the Bank and its capital markets activities
  • Provides legal analysis, documentation, negotiation, preparation, review, research and advice and counsel to line management on matters of above average complexity in the development of new programs.
  • Researches legal issues of substantial complexity on a national and cross-border basis as well as proposed federal and provincial legislation to evaluate impact on the Bank; may initiate the research of more junior counsel or articling students; informs management on developing legal trends and their impact on operations and recommends courses of action; creates and maintains systems and precedents within the Legal Department and for use by business line partners as appropriate
  • Represents the Bank at meetings or on committees with government, public and private organizations; researches and prepared submissions to government bodies on legislation and other issues affecting the organization.
  • Provides subject matter expertise in connection with matters under litigation and the course of action to be taken in relation thereto.
  • Directs the activity of outside counsel. Supervises the work of counsel and staff within a group, including setting work standards, methods and procedures within the Department in accordance with company-wide policies and appraising work performance.
  • Understands how the Bank’s risk appetite and risk culture should be considered in day-to-day activities and decisions
  • Ensures timely action is taken to effectively manage and mitigate risks, including prompt escalation of breaches of management limits or risk appetite measures as per established processes.
  • Actively pursues effective and efficient operations of his/her respective areas in accordance with Scotiabank’s Values, its Code of Conduct and the Global Sales Principles, while ensuring the adequacy, adherence to and effectiveness of day-to-day business controls to meet obligations with respect to operational, compliance, AML/ATF/sanctions and conduct risk.

Education and Experience Required

  • Graduate of a nationally recognized law school.
  • Membership in the Law Society of one of the provinces of Canada.
  • At least 8-10 years of experience with a major financial institution or law firm specializing in capital markets and financial service activities
  • Covers a broad range of Bank-related matters and specialized areas of law, typically on a cross-border basis. The applicable laws and regulations are numerous, varied and highly complex
  • Under general direction of the Managing Director & Head, GBM Legal or Deputy General Counsel, the incumbent will research, analyze and advise on highly complex legal issues, with little or no precedent.
  • The position requires a high degree of analytical and communications skills, and a thorough knowledge of specialized areas of law. Highly developed human relations and management skills are critical.
  • Excellent problem-solving skills.
